Inheritance Power of Attorney Services in Dubai
One Representative for Courts, DLD and Banks
An inheritance power of attorney is a special power of attorney by which an heir appoints a representative to act in the estate of a deceased person in Dubai. The representative acts in the inheritance file at the Dubai Courts, in the registration or sale of inherited property at the Dubai Land Department (DLD) and in the release of the deceased's bank balances. A power of attorney for inheritance names the deceased and lists each act the representative may perform.
The power of attorney is drawn up in Arabic or as a bilingual Arabic and English instrument and attested by a notary public in Dubai. The heir signs it before the notary in person or by video conference under the digital notary rules of the Dubai Courts.
At EGSH, the power of attorney is drafted, translated and notarised through the EGSH Notary Department, which provides notary public services in Dubai without queues and in one visit.

Power of Attorney for Inheritance: Who Can Appoint Whom
The power of attorney is signed by the heir as principal after the death. Each heir signs in his or her own name, and several heirs can sign one instrument and appoint the same representative. A power of attorney that the deceased gave during his or her lifetime ends with the death, and a person who acted under it needs a new power of attorney from the heirs.
The representative appointed by the heirs, the inheritance attorney, can be a family member, a friend or a lawyer. An inheritance POA lists the authorities one by one: representation in the inheritance file, registration of the inherited property, the sale of that property and dealings with named banks. A general authority to manage the heir's affairs does not cover a sale or a settlement, which the court, the DLD and the banks accept only where the power of attorney states them expressly.

Power of Attorney for the Inheritance Case at Dubai Courts
The inheritance file is opened at the Dubai Courts. Under the power of attorney, the representative files the application for the heir, submits the death certificate and the documents identifying the heirs, and receives the Legal Notification of Inheritance, also called the inheritance certificate or succession certificate, together with the court's letter to the DLD. A death certificate issued abroad is submitted as an attested death certificate with its Arabic translation.
Inheritance files of non-Muslims are examined by a dedicated department of the Dubai Courts, established in 2023. Where a will was issued or authenticated by the DIFC Courts, the Dubai Courts do not open the file, and probate in Dubai for that estate is obtained by the executor from the DIFC Courts.
The representative may admit a claim, waive a right, settle or agree to a division of the estate only where the power of attorney expressly authorises each of these acts. The stages and how long the inheritance process takes depend on the estate, the existence of a will and the number of heirs.

Releasing the Deceased's Bank Accounts Through a Representative
Banks release the balances held in the deceased's accounts to the heirs against the court document identifying them. Each bank sets its own document requirements for this release.
For this task, the power of attorney names each bank and, where known, the account numbers, and lists the acts the representative may perform: requesting statements, submitting the court documents and receiving the heir's share or transferring it to the heir's account. A limited power of attorney for bank accounts covers only the banks and acts it lists.

Registering or Selling Inherited Property at DLD Through Your Representative
The DLD registers inherited property in the heirs' names through its Inheritance Title Transfer service. The application is based on the Legal Notification of Inheritance and an official letter from the Dubai Courts, another UAE court or the Awqaf and Minors Affairs Foundation addressed to the DLD. It also requires copies of the Emirates ID of resident heirs, copies of the passports of non-resident heirs, and a no objection letter from the bank if the property is mortgaged or from the developer under a preliminary sale agreement. A representative authorised to apply for the transfer can register the inherited property in the heirs' names and receive the new title deed.
A power of attorney to sell property states the sale expressly and identifies the property as shown on the title deed, with the title deed number. An authority to manage the property does not include the right to sell it. The sale is registered through the heirs' sale procedure at DLD, in which the heirs' shares of the price are transferred to their own bank accounts. The representative signs the sale on behalf of the heirs at a Real Estate Registration Trustee centre, so selling inherited property from abroad does not require the heirs to attend.

Notarial Requirements and Signing by Video Conference
Under Law No. (4) of 2013 Concerning Notaries Public in the Emirate of Dubai, notarial instruments are written in Arabic. A bilingual instrument contains both texts in one document, and each page is signed opposite each text. The notary verifies the identity of the heir through a passport or Emirates ID and declines the application where the heir's capacity, identity or consent cannot be verified.
Signing by video conference is governed by Resolution No. (137) of 2022 of the Dubai Courts. The heir registers on the digital channels of the Dubai Courts, enters the transaction details, uploads the documents and pays the fee. The notary reviews the application and calls the heir by video between 7:00 a.m. and 9:00 p.m. to verify identity, capacity and consent. The heir confirms with a one-time password, and the notary signs the power of attorney electronically.
An application is deemed rejected where registration is not completed within five working days, where the data and documents are not uploaded within 60 days, or where the heir misses the notary's call more than twice.

Inheritance Law in the UAE: Which Rules Apply to the Estate
The inheritance of non-Muslim UAE citizens and non-Muslim foreigners residing in the UAE is governed by Federal Decree-Law No. (41) of 2022 on Civil Personal Status, unless a person adheres to the law of his or her own country. The Decree-Law provides for equal shares for men and women. In the absence of a will, half of the estate goes to the surviving spouse and the other half is divided equally among the children.
Under the same Decree-Law, a non-Muslim may leave a will covering all of his or her property in the UAE, and a will registered in Dubai takes precedence over the distribution set by law. Any heir of a foreigner may ask the court to apply the law governing the estate under the Civil Transactions Law, unless a registered will provides otherwise, and the court decides which law applies to a foreigner's estate. The inheritance of Muslims follows Sharia law under Federal Decree-Law No. (41) of 2024 on the Issuance of the Personal Status Law.

Frequently Asked Questions
What is an inheritance power of attorney?
It is a special power of attorney that an heir signs after a death to appoint a representative for the estate. The representative acts for the heir at the Dubai Courts, the Dubai Land Department and the banks, within the authorities the document lists.
Can heirs living abroad handle an inheritance in Dubai through a representative?
Yes. An heir who cannot attend in Dubai signs the power of attorney before a Dubai notary by video conference, and the representative then acts in the inheritance file, at the DLD and at the banks. For the inheritance title transfer, the DLD accepts copies of the passports of non-resident heirs.
Can my representative act for me at Dubai Courts in the inheritance case?
Yes, where the power of attorney authorises representation before the Dubai Courts in the named estate. The representative files the application and receives the Legal Notification of Inheritance and the court’s letter to the DLD. Admitting a claim, waiving a right or agreeing to a settlement requires express authority in the power of attorney.
How do I get an inheritance certificate in Dubai?
The Legal Notification of Inheritance is issued by the Dubai Courts in the inheritance file. The application includes the death certificate, attested if issued abroad, and the documents identifying the heirs. Inheritance files of non-Muslims are examined by a dedicated department of the Dubai Courts.
Can I sign an inheritance power of attorney by video call?
Yes. Under Resolution No. (137) of 2022, the heir applies online for the notary service, and the notary verifies identity, capacity and consent in a video call. The power of attorney is signed electronically and sent to the heir’s personal e-mail.
How do heirs release money from a deceased person’s UAE bank account?
The bank releases the balances to the heirs against the court document identifying them. A representative with a power of attorney naming the banks submits this document and receives or transfers each heir’s share. Each bank sets its own document requirements.
How much does an inheritance power of attorney cost in Dubai?
Under Executive Council Resolution No. (72) of 2025, the notary fee is AED 100 per signature attested on a power of attorney, plus AED 100 per party for the electronic entry of transaction data. Translation and the EGSH service fee are charged in addition.
What inheritance laws apply in the UAE?
Federal Decree-Law No. (41) of 2022 on Civil Personal Status applies to non-Muslims and gives men and women equal shares. Without a will, half of the estate goes to the spouse and half to the children in equal shares, and an heir of a foreigner may ask the court to apply the law governing the estate. For Muslims, inheritance follows Sharia law under Federal Decree-Law No. (41) of 2024 on the Issuance of the Personal Status Law.
Do I need to travel to Dubai to sign an inheritance power of attorney?
No. An heir outside Dubai can sign before a Dubai notary by video conference after registering on the digital channels of the Dubai Courts. Non-residents register with the unified number of an earlier UAE entry permit.
What happens if one heir disagrees or does not sign a power of attorney?
Each heir signs only his or her own power of attorney, and the representative acts only for the heirs who appointed him or her. A disagreement over the estate is decided by the court.
