A usufruct is a legal right recognised by the Dubai Land Department (DLD) that allows a person or a company to use and benefit from another party’s property for a fixed term, without acquiring ownership. In practice, the usufruct holder may live in, lease, or otherwise benefit from the property, while the owner retains full legal ownership of the land or unit.
This type of right is commonly granted for long-term arrangements, such as development projects or investment leases, and is governed by Federal Law No. 5 of 1985 (UAE Civil Transactions Law). Registering the usufruct with the DLD ensures that the interests of both are legally protected and that the right can be enforced before the authorities and the courts.
A usufruct amendment is an official DLD procedure that enables the property owner or beneficiary to update the registered terms of an existing usufruct agreement. Such amendments are typically required when the parties agree to extend or shorten the contract duration, adjust its financial value, or correct data previously entered in the DLD records.
Once the change is approved and registered, the DLD issues an updated Certificate of Title for Usufruct Right showing the new details. This ensures that the contract remains valid, enforceable, and accurately reflected in Dubai’s unified land registry.

To amend a usufruct agreement in Dubai, applicants must submit a complete and valid set of supporting documents according to their legal status.
In freehold areas, individuals must obtain an electronic no-objection certificate from the developer through the Dubai REST App. The applicant must present a UAE Emirates ID for identity verification or a valid passport for non-residents. A legal power of attorney is required if the application is submitted by a representative.
For a sole establishment, a valid trade licence is required, along with an Emirates ID or passport for identification. If a representative applies on behalf of the establishment, a power of attorney must be provided.
For a limited liability company, the documents include a trade licence with the company details page, a certificate of job title, and a Memorandum of Association with all annexes, attested by the Ministry of Foreign Affairs and, if necessary, translated into Arabic. A power of attorney or a notarised board resolution is also required to authorise the representative.
The DLD applies fixed charges for all usufruct amendments in Dubai. Fees vary depending on the amendment value and property type, and must be settled before the updated deed is issued.

If the amendment involves a change in financial value, the DLD charges 2% of the new amount from both the owner and the lessee. For amendments that affect only the contract term, fixed service fees apply instead. Additional DLD fees include AED 1,000 for the usufruct amendment, AED 250 for the Title Deed, and AED 100–250 for the updated property map, depending on the type and location.
A new Certificate of Title reflecting the updated usufruct terms is issued by the Dubai Land Department. EGSH ensures the updated Title Deed and Property Map are delivered electronically after registration.
A non-resident can amend a usufruct agreement through an authorised representative. A valid notarised power of attorney is required.
