When Can an Employer File an Absconding Report

Article 6 of Ministerial Resolution No. (47) of 2022 sets out four cumulative conditions for a valid UWA complaint:

  • The worker has been absent without lawful reason for more than seven consecutive days.

How to File an Absconding Report in Dubai

Two channels are available for submitting a UWA report for private-sector workers.

Filing Through the MoHRE App or Website

The employer or authorised signatory follows these steps:

  1. Download the MoHRE app or access mohre.gov.ae.

Consequences of an Absconding Report for the Employee

A confirmed UWA report triggers several legal and administrative consequences under UAE immigration and labour regulations.

Visa cancellation. The employee's work and residence visa is cancelled. Cancellation proceeds through the immigration authority — the Federal Authority for Identity, Citizenship, Customs and Ports Security (ICP) or GDRFA — after MoHRE approves the report.

Labour ban. Article 8 of Ministerial Resolution No. (47) of 2022 provides that a worker whose UWA report is confirmed will not be granted a new work permit for one year from the date of departure from the UAE. Travel restrictions. A travel ban may be imposed while the report is active. The employee may be prevented from leaving the UAE until the case is resolved or outstanding fines are settled. Airport immigration checks will identify any active flags at the point of departure.

Loss of employment benefits. End-of-service gratuity may be forfeited where the employee's absence constitutes a breach of the employment contract. The employer is not obligated to settle outstanding benefits until the absconding case is resolved.

Overstay fines. If the employee remains in the UAE without a valid visa after cancellation, daily overstay fines apply. The employee must regularise their status through the MoHRE, the GDRFA, or voluntary departure to avoid accumulating further penalties.

How to Cancel an Absconding Report in the UAE

Article 7 of Ministerial Resolution No. (47) of 2022 lists the conditions under which MoHRE may cancel a UWA report at the request of either party:

  • Fewer than seven consecutive days have passed since the last working day or the end of the worker's leave.
  • The worker is proven to have been present at the workplace or on legally prescribed leave at the time of filing, regardless of the employer's awareness.
  • The employer consents to restore the employment relationship. The establishment must be active, and the employer must resolve any outstanding fines.
  • The parties reach a mutual agreement to terminate the employment relationship.
  • The employer agrees to allow the worker to transfer to a new employer.

Cancellation for Domestic Workers

Ministerial Resolution No. (674) of 2022 applies separate conditions:

  • The domestic worker's absence does not exceed 10 consecutive days, or 10 consecutive days have not passed since the end of their leave.
  • The domestic worker is proven to have been present at the workplace at the time the report was filed.
  • The domestic worker returns to the recruitment agency where they were recruited.
  • Evidence demonstrates that the report was inaccurate.

MoHRE may also cancel the report with the employer's approval, regardless of the circumstances above.

Cancellation Process

  1. The employee contacts the employer and requests a withdrawal letter or NOC.
  2. The employer submits the withdrawal through the MoHRE app, the MoHRE website, or an authorised Tasheel centre.
  3. MoHRE verifies and processes the request in approximately three working days.
  4. ICP or GDRFA clears the blacklist record. This step takes approximately five to seven additional days.

An employee may also file a counter labour complaint with MoHRE if the absconding report was filed unfairly — for example, in cases of unpaid wages or contract violations. Absconding Report vs. Labour Complaint

Absconding reports and labour complaints are distinct MoHRE procedures, but they frequently intersect.

An absconding report (UWA) is filed by the employer when the worker is absent for more than seven consecutive days. It results in visa cancellation and a one-year work permit ban.

A labour complaint is filed by either party when the other breaches the employment contract. MoHRE mediates within 14 days under Article 54 of Federal Decree-Law No. (33) of 2021. If mediation fails, the case is referred to the Labour Court.
